Welcome to The Mug Creative! These Terms & Conditions (“Terms”) govern your use of our website, digital products, website templates, and related services.

By accessing our website or purchasing a product from The Mug Creative, you agree to these Terms. If you do not agree with these Terms, please do not use our website or purchase our products.

1. About The Mug Creative

This website is owned and operated by The Mug Creative, a branding and website design studio based in St. Petersburg, Florida.

Throughout these Terms, “we,” “us,” and “our” refer to The Mug Creative. “You” and “your” refer to the person accessing our website or purchasing one of our products.

2. Digital Products

The Mug Creative sells digital products, including website templates designed for use with Showit, as well as other digital resources that may be offered from time to time.

Unless specifically stated otherwise, no physical product will be shipped.

You are responsible for reviewing the product description and requirements before purchasing to ensure the product is appropriate for your needs.

3. Showit Requirements

Our Showit website templates require an active Showit subscription.

Your purchase from The Mug Creative does not include your Showit subscription, domain name, third-party software or subscriptions, premium fonts, stock photography, or other third-party products unless specifically stated on the applicable product page.

Showit is a third-party platform and is not owned, operated, or controlled by The Mug Creative. We are not responsible for changes to Showit’s services, pricing, functionality, availability, or policies.

4. Purchases & Payment

All prices are displayed in U.S. dollars unless otherwise stated.

By completing a purchase, you represent that you are authorized to use the payment method provided and agree to pay all charges associated with your order, including any applicable taxes.

Payments may be processed through third-party payment providers. We do not control and are not responsible for the policies or practices of those third-party providers.

We reserve the right to change our prices, products, promotions, and offerings at any time.

5. Refunds

Because our products are digital and access is provided electronically, all sales are final unless otherwise required by law.

We do not offer refunds, returns, or exchanges because you changed your mind, decided not to use the product, purchased the wrong product, or no longer need the product.

6. License to Use Our Templates

Purchasing a website template does not transfer ownership of the template or its underlying design to you.

Your purchase grants you a limited, non-exclusive, non-transferable license to customize and use the purchased template for one website for one business or brand, unless a different license is expressly provided at the time of purchase.

You may customize the template’s colors, fonts, copy, imagery, layout, and other design elements for your own website.

You may not:

  • Resell, redistribute, share, sublicense, or give away the template or template share key.
  • Claim the original template design as your own work.
  • Sell or distribute modified versions of the template.
  • Use one template purchase to create websites for multiple businesses, brands, clients, or projects.
  • Share your purchased template with another person or business for their independent use.
  • Copy or reproduce substantial portions of our templates for the purpose of creating competing templates or digital products.
  • Make our templates or any portion of them available for download, resale, licensing, or redistribution.

If you wish to use one of our templates for more than one website, an additional license must be purchased for each website.

7. Designers & Client Use

Unless otherwise stated, a standard template purchase is intended for use by the purchasing business on one website.

Designers, developers, virtual assistants, or other service providers may customize a purchased template on behalf of the licensed purchaser. However, possession of a template does not grant the service provider the right to reuse that template for other clients.

A separate license must be purchased for each client website or business using the template.

8. Intellectual Property

All original content available through The Mug Creative, including but not limited to website templates, layouts, graphics, designs, branding, copy, educational materials, videos, downloads, and other digital content, is owned by or licensed to The Mug Creative and is protected by applicable intellectual property laws.

Purchasing one of our products gives you permission to use that product according to the license provided. It does not transfer copyright or ownership of our intellectual property to you.

All rights not expressly granted under these Terms are reserved by The Mug Creative.

9. Fonts, Images & Third-Party Assets

Some templates may feature fonts, photographs, graphics, illustrations, or other assets owned by third parties for demonstration purposes.

Unless explicitly stated otherwise, these assets are not necessarily included with your purchase.

You are responsible for obtaining any licenses required for fonts, photography, graphics, software, or other third-party assets you choose to use on your website.

We may provide links or recommendations for obtaining certain third-party assets as a convenience, but we cannot guarantee their continued availability, pricing, or licensing terms.

10. Template Content & Customization

Our templates are designed to provide a starting point for your website. You are responsible for customizing your template with your own business information, copy, images, policies, disclaimers, and other content.

You are solely responsible for ensuring that your completed website complies with laws, regulations, accessibility requirements, privacy requirements, and industry-specific rules applicable to your business.

11. Support

Your purchase includes only the support specifically described on the applicable product page.

Unless otherwise stated, template purchases do not include custom design services, website development, copywriting, SEO services, third-party integrations, troubleshooting of custom code, or ongoing website maintenance.

We may provide tutorials, documentation, or other educational resources to assist you with customizing your template.

12. No Guarantee of Results

We put a lot of thought into creating strategic, professionally designed website templates, but we cannot guarantee any particular business outcome from using one.

We make no guarantees regarding sales, revenue, website traffic, search engine rankings, conversions, leads, bookings, audience growth, or other business results.

Your results depend on many factors outside of our control, including your business, offer, content, marketing, audience, and implementation.

13. Website Availability & Technical Issues

We make reasonable efforts to keep our website and digital products available and functioning properly, but we cannot guarantee uninterrupted or error-free access.

We are not responsible for outages, errors, lost data, software incompatibilities, security incidents, or other issues caused by third-party platforms, hosting providers, payment processors, plugins, software, or services outside of our control.

14. Prohibited Use

You may not use our website or products for any unlawful purpose or in a way that infringes upon the rights of The Mug Creative or any third party.

To the fullest extent permitted by law, our total liability relating to a purchased product will not exceed the amount you paid to The Mug Creative for that specific product.
